1. Acceptance of Terms

By accessing and using OpenNow, you accept and agree to be bound by the terms and provision of this agreement.

2. Use License

Permission is granted to temporarily access the materials (information or software) on OpenNow for personal, non-commercial transitory viewing only.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

4. Real Estate Professional Requirements

All users must be licensed real estate professionals. You agree to provide accurate licensing information and maintain active professional status during your use of the platform.

5. Service Description

OpenNow provides a platform connecting listing agents with hosting agents for open house events. We facilitate connections but do not guarantee availability, quality, or outcomes.

6. Subscription & Payment Terms

Access to core platform features requires a monthly subscription at $99/month. A 15% platform fee is applied to each booking. Payments are processed securely through Stripe.

  • Subscriptions renew automatically each month until cancelled
  • You may cancel your subscription at any time; access continues through the end of the billing period
  • Listing agents set compensation amounts; OpenNow facilitates payment between parties
  • Platform fees are deducted from the compensation amount before payout to the hosting agent's brokerage
  • Refunds are handled on a case-by-case basis; contact support for disputes

7. Prohibited Activities

You agree not to:

  • Use the service for any illegal purpose
  • Violate any real estate laws or regulations
  • Harass, abuse, or harm other users
  • Provide false or misleading information
  • Attempt to gain unauthorized access to the platform

8. SMS/Text Messaging

By opting in to OpenNow's SMS messaging program during registration, you consent to receive text messages at the mobile phone number you provide. Consent is not a condition of registration, purchase, or use of our services.

Types of messages: Open house confirmations, schedule updates, event reminders, and support messages.

Message frequency: Varies based on your activity. You may receive up to approximately 10 messages per week during active periods.

Costs: Message and data rates may apply depending on your mobile carrier and plan. OpenNow does not charge for SMS messages.

Opt-out: You can stop receiving SMS messages at any time by replying STOP to any message, updating your notification preferences in account settings, or contacting us at support@open-now.com. After opting out, you will receive one final confirmation message.

Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of information sharing described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text messaging platform used to deliver messages.

Supported carriers: Major US carriers are supported including AT&T, Verizon, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.

9. Mobile Application

The OpenNow iOS app provides access to the platform through a native application. Your use of the mobile app is subject to these Terms as well as any applicable app store terms. Push notifications may be sent to your device; you can manage notification preferences in your account settings or device settings.

10. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of OpenNow.

11. Limitation of Liability

In no event shall OpenNow, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes.
